These Terms govern your use of Blueping (blueping.dev), an iMessage API for developers operated by [Company], based in France. They are a contract between [Company] and you, or the business you represent. By creating an account or using the API, you accept them.
What Blueping is
Blueping lets your app send and receive iMessages through the Blueping line, using a JSON API. Blueping is an independent service, not affiliated with Apple. Apple has no public iMessage API. Apple and iMessage are trademarks of Apple Inc.
Blueping is for businesses and developers acting for professional purposes. It is not offered to consumers. If you accept these Terms for a company, you confirm that you are authorized to bind it.
Your account and API key
You open an account at blueping.dev/start by texting a 6-character code from your iPhone to the Blueping line. The page then shows your API key, and your iPhone becomes the contact “me”. There is no password. To sign in later, text LOGIN to the line and open the one-time link it sends back.
Keep your API key secret: anyone who holds it can act for your account. You are responsible for all activity under your key and for keeping control of the phone number or Apple email linked to your account. If your key may have leaked, replace it with POST /v1/keys.
How the shared line works
The free plan runs on a line shared by all Blueping accounts. Each account has a join code and a join link (blueping.dev/j/CODE). Apart from your own iPhone, your app can text a person only after that person has texted your code to the line.
A person talks to one app at a time, and texting another app's code switches apps. Blueping answers the line's keywords itself: MENU lists the person's apps, LEAVE leaves the current one, HELP explains the line, and STOP unsubscribes the person from every app on the line. Texting a code again after STOP is a fresh opt-in.
Free plan and limits
The free plan costs $0. A dedicated number is coming soon, with a waitlist. Any paid plan will show its price and terms before you subscribe. The free plan works within these limits:
- 100 messages a day per account, reset at 00:00 UTC.
- At most 5 messages in a row to a person before that person replies. A reply resets the count.
- A daily volume for the whole shared line. When it is reached, the API returns line_busy.
- Text only, up to 2,000 characters per message. API v1 does not support attachments.
- iMessage only: people need an iPhone, iPad or Mac. No SMS, no Android.
- No typing indicators, read receipts or tapbacks.
Acceptable use
You may text only people who joined your app by texting your code. You must not use Blueping to:
- send marketing or promotional blasts, or do cold outreach;
- send the same or nearly the same message to many people;
- send content that is illegal or deceptive;
- send adult content, or content related to gambling, weapons or drugs;
- send hateful content;
- impersonate anyone, including with an app name that poses as another company;
- run a service aimed at minors.
Your obligations to the people you text
Honor opt-outs immediately. Blueping handles STOP for you. When someone refuses in their own words, such as “please stop texting me”, report it with POST /v1/contacts/{id}/opt-out and stop texting them. If your replies are automated and someone asks, say so.
You are responsible for the messages your app sends and for complying with the laws that apply to them, including where your recipients live. Tell the people who join your app who you are and how you use their data.
Suspension and closing your account
We may suspend an account at once, without notice, for abuse, including any breach of the acceptable use rules. We will tell you the reason unless the law prevents it, and you can contest the decision at hello@blueping.dev.
You can stop using Blueping at any time. To close your account, email hello@blueping.dev. Its data is then deleted as described in our Privacy Policy.
Availability
Blueping is provided as is, without any commitment on uptime or delivery. Delivery depends on Apple's iMessage service, which we do not control. We may limit, change or replace the shared line at any time.
Liability
To the extent the law allows, our total liability to you under these Terms is limited to the fees you paid us in the 3 months before the event giving rise to the claim. On the free plan you pay nothing, so that amount is zero. We are not liable for indirect losses or for failures of Apple's services.
These limits do not apply where the law forbids them, for example in cases of fraud or gross negligence.
Personal data
For the personal data of the people your app texts, you are the controller and we act as your processor. We process that data only to run Blueping for you, following the instructions you give through the API, and we keep it confidential. Cloudflare hosts the service as our sub-processor. Messages are deleted after 90 days. We will help you answer requests from the people concerned and tell you without undue delay of any personal data breach affecting them.
For your own account data, we are the controller. Our Privacy Policy covers both cases.
Changes to these Terms
We may update these Terms. The current version and its date are always on this page. We will notify you before a significant change takes effect, and if you keep using Blueping after that date, the new Terms apply.
Governing law and disputes
These Terms are governed by French law. Before going to court, write to hello@blueping.dev so we can try to settle the matter. Failing that, the French courts have jurisdiction, unless a mandatory rule gives you another forum. If you use Blueping as a consumer in the European Union, you keep the mandatory protections of the law of your country of residence.
